General terms and conditions

§ 1 Basic provisions

1) The following terms and conditions apply with all orders in the online shop on the site and the contracts resulting from the same that are between the company Exklusive by Nicki Miller, legally represented by Mrs. Nicki Miller, Burgstrasse 9, 87466 Oy-Mittelberg – hereinafter referred to as the Provider – and the client i.e. anyone who becomes as such via the Provider's website, unless any change has been agreed between the parties in writing. Differing or contrary terms and conditions are permissible only with the express consent of the Provider.

2) The Provider shall only offer their product for purchase if the client is an individual, a legal entity or a partnership who, at the time of the conclusion of a legal transaction, practices their own commercial or independent professional activity (entrepreneur).

3) The prices valid at the time of an order shall apply. All of our prices include the legally valid VAT rate applicable at the time of any given order plus dispatch costs. In the case of retailers, the prices shall not include VAT. The legally valid VAT rate and the dispatch costs are listed separately on an invoice. The invoice amount shall be due for payment immediately anything else has been stipulated at the time of the conclusion of the contract or otherwise agreed. Invoices shall not be sent separately, and can be printed in a customer account.

4) The products in our Internet shop can only be sold / sent to persons over the age of 18. At the time of the registration and any subsequent orders, the buyer confirms that they are at least 18. The company Exklusive by Nicki Miller accepts no liability in the event of any of its products ending up in the hands of those under 18.

§ 2 Object of contract The object of this contract is the sale of products. The details, in particular the essential characteristics of the product, are included in the description of the article and the additional information on the Provider's website.

§ 3 Contract establishment All offers from suppliers shall be detached and non-binding, and they constitute no binding offer with regard to the conclusion of the transaction. The purchase contract shall come into being following the order of, the payment for and the dispatch of the product. A confirmation of the order / purchase shall be automatically sent to the buyer / client.

§ 4 Delivery conditions The period for the delivery of the goods, and their availability, is outlined in the article description. In the event of any unexpected deviating delivery periods, the client / buyer shall be informed of them in writing. The prescribed deadlines may vary in the case of overseas deliveries. If it should exceed 14 days, the client shall be informed about it separately.

§ 5 Retention of title The product shall remain in the possession of the company Exklusive by Nicki Miller until all the demands of the buyer / client have been fulfilled.

§ 6 Warranty The warranty is determined by the appropriate legal provisions. A warranty claim shall only be valid if the product is still in its original packaging. The deadline shall begin on the third working day after the day of the dispatch.

§ 7 Guarantee The Provider's products are expected to be flawless and functional. With single use products e.g. eyebrow hair removal strips etc. there is a shelf life of 6 months.

§ 8 Right of return The buyer / client has an unrestricted right of return, and may return the product within 14 days, without having to provide a reason. The product must be in its original packaging when it is received by the Provider - the client can choose between an exchange or a refund of the amount paid. The deadline begins after the third working day after the dispatch.

§ 9 Data protection The client hereby confirms to the Provider that all legally permissible received data in connection with the business relationship may be processed and saved. The client and order data shall be used only for the purpose of the delivery of the order and settling any complaints, unless the buyer / customer wants to make any additional payments, such as for a newsletter etc. Such additional payments must be confirmed / specified at the time of the registration. Information may only be forwarded to third parties if it is necessary for the execution of the contract / dispatching of the product. In all other cases, the data must be kept strictly confidential; it may not be made accessible to any third parties. The customer has a right to free information, and the right to have their saved information corrected, blocked and deleted.

§ 10 Place of performance and jurisdiction German law applies, excluding the UN Sales Convention. The place of performance and jurisdiction is the headquarters of the Provider.
